CJEU's case law cited by the court
BIT (claimant) obtained an EPO against NFSI (defendant). NFSI filed a statement of opposition, after which, in accordance with Art. 17 EPO, the case is continued before the Dutch court following national civil procedural law. The court ordered BIT to review its documents initiating proceedings, as it did not fulfill the requirements prescribed by the relevant civil procedural provisions. The court stayed further decision and referred the case to a later date.
